Terms of Service

1. Agreement to Terms

By accessing or using the FundaFX mobile application and API services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you ("User," "you") and FundaFX ("we," "us," "our").

2. Service Description

FundaFX is a foreign exchange (FX) fundamental analysis service that provides:

Curated economic fact feeds sourced from public data providers (ECB, IMF, World Bank, GDELT, and news RSS feeds).
Economic calendar with event tracking.
Currency strength indicators and rate trend analysis.
Central bank policy information.
Push notifications for significant economic events (Pro tier and above).
API access for programmatic data retrieval.

The Service aggregates, processes, and presents publicly available economic and financial data using automated pipelines including AI-assisted analysis.

3. Account Terms

3.1 Registration

To use the Service, you must register and obtain an API key. You agree to:

Provide accurate and complete registration information.
Keep your API key confidential and secure.
Notify us immediately if you suspect unauthorized use of your API key.
Not share, sell, or transfer your API key to any third party.

3.2 API Key Security

API keys are prefixed with fndx_ and are hashed (SHA-256) for storage. You are responsible for all activity that occurs under your API key. We are not liable for any loss or damage arising from unauthorized use of your credentials.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms, including but not limited to exceeding rate limits persistently, engaging in abusive behavior, or redistributing Service data without authorization.

4. Subscription Terms

4.1 Tiers and Pricing

Annual subscription options may be available at a discounted rate.

4.2 Billing and Auto-Renewal

Subscriptions are billed through the Apple App Store or Google Play Store.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
You can manage and cancel your subscription through your device's app store settings.

4.3 Refunds

Refund requests are handled by Apple or Google according to their respective refund policies.
We do not process refunds directly. Please contact the app store where you made the purchase.

4.4 Price Changes

We may change subscription pricing with at least 30 days' notice. Price changes will not affect your current billing period. Continued use after a price change takes effect constitutes acceptance of the new pricing.

5. Acceptable Use

You agree NOT to:

Exceed rate limits — Respect the rate limits associated with your subscription tier.
Redistribute data — You may not redistribute, resell, sublicense, or commercially exploit data obtained through the Service without prior written consent.
Reverse engineer — You may not reverse engineer, decompile, or attempt to extract the source code of the Service.
Automate access beyond API — You may not scrape, crawl, or use automated tools to access the Service outside of the provided API.
Interfere with the Service — You may not attempt to disrupt, overload, or compromise the security or integrity of the Service.
Misrepresent affiliation — You may not imply that you are affiliated with, endorsed by, or acting on behalf of FundaFX.

6. Intellectual Property

6.1 Our Content

The Service, including its design, features, AI-generated analysis, and aggregated data presentations, is owned by FundaFX and protected by applicable intellectual property laws. Original source data remains the property of its respective providers (ECB, IMF, World Bank, etc.) and is subject to their terms of use.

6.2 Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a limited license to use it for the purpose of providing and improving the Service.

7. Nature of the Service — No Advisory Relationship

7.1 Informational Purpose Only

The Service is an information aggregation tool that collects, processes, and presents publicly available economic and financial data. The Service is provided solely for informational and educational purposes.

7.2 No Advisory or Fiduciary Relationship

BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT:

No advisory relationship exists. Your use of the Service does not create any advisory, fiduciary, professional-client, or other relationship between you and FundaFX.
No financial services registration. FundaFX is not a registered investment advisor, financial instruments business operator, broker-dealer, or any other regulated financial services provider under the Financial Instruments and Exchange Act of Japan or any other applicable law.
No investment advice. Nothing in the Service constitutes investment advice, financial advice, trading advice, tax advice, legal advice, or any other form of professional advice.
No duty of care regarding investment decisions. FundaFX owes no duty of care to you with respect to any investment, trading, or financial decision you may make.

7.3 Investment Decisions Are Your Sole Responsibility

If you choose to use any information obtained through the Service in connection with investment, trading, or any other financial decision, such use is entirely your own independent decision, made at your own discretion and at your own risk.
You bear sole and complete responsibility for any and all investment, trading, and financial decisions you make.
FundaFX bears no responsibility whatsoever for the outcome of your investment or trading decisions.
You should consult a qualified, licensed financial advisor before making any investment or trading decisions.

8. AI Processing and Data Accuracy Disclaimer

THE SERVICE USES ARTIFICIAL INTELLIGENCE (AI) AND AUTOMATED PROCESSING PIPELINES. YOU ACKNOWLEDGE AND AGREE THAT:

AI-generated content MAY CONTAIN ERRORS, INACCURACIES, OMISSIONS, MISINTERPRETATIONS, OR MISLEADING INFORMATION.
Automated data collection may result in incomplete, delayed, outdated, or incorrectly attributed information.
We do not independently verify the accuracy of source data, and source data itself may contain errors.
AI models may hallucinate, misinterpret, or misrepresent the meaning of source materials.
Currency strength indicators and quantitative outputs are algorithmic calculations and DO NOT represent predictions or guarantees of future market movements.

YOU EXPRESSLY ACKNOWLEDGE THAT THE INFORMATION PROVIDED BY THE SERVICE MAY BE WRONG, AND YOU ASSUME ALL RISK ASSOCIATED WITH ANY RELIANCE ON SUCH INFORMATION.

9. Acknowledgment of Risks and Self-Responsibility

9.1 Market Risks

Foreign exchange and financial markets involve substantial risk of loss.
Past economic conditions and data trends do not predict future market performance.

9.2 Information Accuracy Risks

Despite our reasonable efforts, the Service may produce inaccurate or misleading content.
You agree that you will independently verify any information obtained through the Service.

9.3 Self-Responsibility

All investment and trading decisions are made at your own risk and under your own responsibility. This is a fundamental condition of your use of the Service.

9.4 Waiver of Claims

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST FUNDAFX ARISING FROM OR RELATED TO ANY FINANCIAL, INVESTMENT, OR TRADING DECISIONS YOU MAKE.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. No Liability for Investment and Trading Outcomes

11.1 No Liability Arising from Investment or Trading Decisions

No liability arises on the part of FundaFX in connection with any investment, trading, or financial decision you make, because (i) no advisory or fiduciary relationship exists, (ii) FundaFX owes no duty of care regarding your decisions, and (iii) you have agreed to bear sole responsibility.

11.2 General Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FUNDAFX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU ACTUALLY PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ¥5,000 JPY.

11.3 Mandatory Exceptions Under Japanese Law

Nothing in these Terms shall exclude or limit liability that cannot be excluded or limited under applicable Japanese law, including the Consumer Contract Act. These Terms do not purport to exclude liability for damages caused by intentional misconduct or gross negligence of FundaFX.

12. Indemnification

You agree to indemnify, defend, and hold harmless FundaFX and its founders, officers, directors, employees, agents, contractors, and affiliates from and against any and all claims arising out of your use of the Service or violation of these Terms.

13. Third-Party Services

The Service integrates with third-party services including but not limited to RevenueCat, Firebase, and Sentry. Your use of these services is subject to their respective terms and privacy policies.

14. Service Availability and Modifications

We strive to maintain Service availability but do not guarantee uninterrupted access.
We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
We reserve the right to modify data sources, analysis methods, and features.

15. Modification of Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms within the app and updating the "Last Updated" date. Your continued use of the Service after revised Terms become effective constitutes acceptance of the changes.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan.

16.2 Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

16.3 Dispute Resolution

Before initiating formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at the email address below. We will make reasonable efforts to resolve the dispute within 30 days.

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and FundaFX regarding the Service.
